The Canadian border is open to tourists again. If you are concerned about your criminal record, you have options to overcome criminal inadmissibility

If you think you are legally barred from entering Canada, don't lose hope, you can still vacation in Canada this summer.

The Canadian border lifted restrictions on fully vaccinated tourists in late summer. This year will be the first full summer of open borders, provided you meet the government's definition of fully vaccinated and not subject to other bans.

However, even if a previous conviction appears on your record, the Government of Canada offers some ways to overcome inadmissibility.

Temporary Resident Permit

A Temporary Residence Permit (TRP) is a temporary solution for those who want to come to Canada with a criminal record. To qualify for this option, you must demonstrate to the Government of Canada that the benefits of your travel outweigh the risks.

The TRP is a solution for those seeking temporary entry to Canada. This may be faster than applying for criminal rehabilitation. Several people choose to apply for both TRP and criminal rehabilitation.

Criminal Rehabilitation

Criminal rehabilitation can permanently end criminal disapproval. If Canada approves your criminal rehabilitation request, your criminal record will no longer bar you from visiting Canada as long as you do not commit other crimes. You cannot apply for rehabilitation until at least five years have passed since your last conviction.

The application fee you pay depends on the severity of your crime, ranging from $200 for non-felony rehabilitation to $1,000 for felony.

Deemed Rehabilitation

If you have been convicted of a non-serious crime for at least 10 years, you may be considered innocent. In this case, under Canadian law, you are automatically presumed innocent and you do not need to apply before visiting.

However, many people consult with a Canadian immigration lawyer before traveling to give them peace of mind. The attorney may write a legal opinion for you to help you avoid unnecessary misunderstandings with CBSA officials upon arrival.

Legal Opinion Letters

A Canadian immigration attorney can prepare a legal opinion detailing your allegations and the attorney's legal analysis of the situation. This letter explains legal issues, identifies risks and relevant Canadian law, and explains why you should be allowed into Canada.

Legal Opinions are available to support a TRP or Rehabilitation Request.

Despite Canada's strict rules on crime, tourism is encouraged for good reason. In the fourth quarter of 2021 alone, tourism contributed $15.4 billion to the Canadian economy, according to Statistics Canada. Therefore, Canada has a vested interest in allowing tourists to enter.

Preparing in advance by understanding your options for overcoming criminal eligibility can help ensure a smooth entry into Canada.
